DELAYS DECISION
UNTIL TUESDAY, (3/9/04)
 
Arthur Bunting and his attorney could not attend today's hearing ... which is exactly why Judge Armstrong should have granted the 3-day continuance request ... since this is the same result anyway ... It's why almost any Judge in America would have granted such a reasonable continuance ... But, remember, this is Atlantic County ...
 
Judge Armstrong will rule from the bench this upcoming Tuesday

ATLANTIC CITY - You have to love justice, Atlantic County style!
 
In a real pain in your wallet ... Six (6) Atlantic City taxpayer-paid attorneys appeared before Judge Val Armstrong ... it would have been at least seven (7) had Bunting been able to attend. You will be paying the whole tab for this useless ... not to mention, bogus process!
 
Attorney's Fred Bor, Joe Gindhart, Chuck Ercole and Irv Jacoby represented the City and various defendants ... Dan Gallagher was also on hand, earning more of your hard-earned tax dollars, doing Craig Callaway's political dirty work.
 
The whole premise of this issue is beyond stupid. Gallagher is representing a client (Callaway/City Council), who says it wants to know where only 12 Atlantic City employees live.
 
An attorney asked Judge Armstrong for Dan Gallagher to answer a very important question ... Does Council's request here apply to all 346 Atlantic City employees who reside outside of the City ... or, does it only apply to "The Callaway 12"?
 
Amazingly, Gallagher said, they are only interested in these 12 employees ... all Langford Department Directors.
 
Judge Armstrong's eyebrow is reported to have raised at this selectivity ... because there are obvious equal protection issues at play here.
 
Additionally, The Callaway/Gallagher agenda has been exposed once and for all. There is no legitimate public purpose to these hearings. They are only meant to publicly embarrass and retaliate against a select few employees.
 
If Judge Armstrong is not in the political tank ... she must rule that they cannot selectively enforce this residency issue with only those few that they would like to ... It must apply to all 346 other employees (who are not presently exempt from the residency policy).
 
Anything short of this and you will all know that the political fix is in and that the rule of law no longer prevails in Atlantic County.
 
Another strong point that was made ... was why can these questions not take place on "camera review" ... in other words, outside of the view of the public ... if the purpose is to simply obtain information ... then why the public circus hearings?
 
Further, all information that Callaway/Gallagher need, can easily be obtained without the expense of a dozen or more attorneys, all being paid for by the taxpayers.
 
This whole matter is a disgrace ... It is scary to think that our legal system can be perverted this way ... we will keep you posted with updates as warranted.
