A well placed source has confirmed that the illegal position will be formally challenged for elimination in the very near future ... as early as later this week!
 
1984 Washington Township New Jersey Decision makes this matter moot ... It's an unambiguous decision ... making it impossible for an Atlantic County Judge to rule otherwise ... It is an already settled matter!

ATLANTIC CITY - Realizing that many strange things have been occurring lately ... like strange judicial decisions ... fraud-tainted elections and more ...
 
However, in a World filled with upside down, inside out craziness ... We have (in our possession) a 100% unambiguous Judicial decision, which makes it clear that the Atlantic City Council MAY NOT have its own solicitor.
 
The case is John Robertson (then) Mayor of Washington Township vs. COUNCIL OF WASHINGTON TOWNSHIP, and Washington Township, a municipal corporation of the state of New Jersey, defendants.
 
Reading straight from the decision:
 
"An examination of the functions of the two attorneys (City Solicitor & the Council Solicitor) as set forth in the administrative code raises an additional problem with the proposed scheme. Both attorneys are required to work on ordinances and resolutions and are to render legal advice to the city council. Having two attorneys doing duplicate work creates the potential for confusion and even stalemate in the event that the advice given by both differs.
 
Taking all of these factors into consideration, the court holds that the provision of Ordinance # 1-1985 creating the office of attorney for council is invalid."
 
END OF STORY.
 
The only reason this illegal position presently exists in Atlantic City ... is simply because it has never been formally challenged in court.
 
HarryHurley.com has learned and confirmed that this is about to change. A formal challenge of this illegal position will take place (as early as this week).
 
EDITOR'S NOTE: Several years ago, former Mayor Jim Whelan successfully took City Council to court ... challenging their creation of a Budget Examiner position, which would have reported directly to City Council. Mayor Whelan prevailed in Atlantic County Court and the position was not permitted to be filled.
 
Unless some unthinkable inconsistency occurs here ... which would be in violation of the law ... the Council will soon lose its Solicitor ... a position it should never have had in the first place.
