HarryHurley.com has learned and confirmed that Atlantic County Judge Max Baker has denied a motion to reconsider the past June, 2003 Primary Election fraud committed in the 3rd Ward Democrat Primary.
 
Baker's rationale is bizarre and appears to be easily challenged should attorney Joseph Gindhart decides to appeal Baker, yet again.
 
Baker ruled that the 40 people (including Freeholder Lawton Nelson) who formally filed the challenge with Baker are essentially the same as if former candidate Stephenine Dixon filed the challenge herself ... it's called "privity" and law requires that you have a basis in fact to assert this.
 
It appears obvious that Baker had no facts to base this decision on ... yet, he has once again made a ruling that can only be interpreted as pro Craig Callaway.
 
As we file this breaking news report ... it is unclear whether Gindhart will once again appeal a Judge Max Baker decision to the New Jersey Appellate Court. Gindhart has successfully appealed Baker at least twice in this case.
 
A serious judicial question remains even after Baker's latest ruling, today. How can Baker rule that 40 citizens of Atlantic City are the same as Dixon (herself) filing a second challenge? This is distturbing to contemplate how Baker could arrive at such a peculiar ruling.
 
The law does not permit Dixon to have a second "bite at this apple" ... So, by Baker mysteriously converting 40 citizens into Dixon "clones" ... he has once again short-circuited a legitimate challenge.
 
After careful review of Baker's conduct throughout this matter ... we strongly urge that Baker needs to be presented to the proper inquiry board, for a formal look into his various actions during Dixon v. Callaway.
