HarryHurley.com has learned first about a block buster ... Which, if successful, would lead to the removal of office of Craig Callaway.
The diverse group of 43 petitioners have filed (today) a number of factual allegations ... We will post the official documents in the very near future here at HarryHurley.com.
However, basically what the petitioners are alleging is that Callaway is ineligible for the office of third ward council person at the time of the November 4, 2003 General Election.
Further, "petitioners, upon information and belief, state that Callaway was ineligible to be a candidate for third ward council person pursuant to N.J.S.A. 19:3-9 et seq. by reason of voter fraud committed by Craig Callaway and his campaign staff during the June, 2003 Democrat Primary," the petitioners state in their official charges against Callaway.
Additionally, "petitioners, upon information and belief, state that Callaway was ineligible as a candidate at the time of the General Election in November, 2003 as the illegal acts complained of were accomplished with his participation, knowledge and consent."
Finally, petitioners are asking the Superior Court of New Jersey by demanding that Judgment be entered as follows:
A. Declaring Craig Callaway ineligible as a candidate for the third ward council person at the November 4, 2003 General Election.
B. Declaring that the Certification of Election issued to Craig Callaway shall be null and void and that Callaway not be inducted into the office of third ward council person.
C. Removal of Craig Callaway from the office of third ward council person.
D. For such further relief as the Court deems reasonable and just.
HarryHurley.com has learned and confirmed that Joseph Gindhart Esq., the attorney for the petitioners.
Of note, is the fact that an appeal is pending in the Appellate Division, Docket No. A001407-03T3, regarding the striking of certain ballots pertaining to the June 3, 2003 Primary Election and the propriety of defendant Craig Callaway as a candidate. This action is being brought separately and pertains to the validity as a candidate pursuant to N.J.S.A. 19:3-9. Though such allegations enunciated herein relate to defendant Craig Callaway's conduct prior to and through the Primary Election conducted in June, 2003, this is an entirely separate and distinct action as set forth in Title 19.
