HarryHurley.com has learned and confirmed that attorney Joe Gindart has done it, again!
 
For the second time in recent weeks Gindhart has had Atlantic County Judge Max Baker reversed and remanded.
 
The State Appellate Court (before Judges Wells and Fisher) formally reversed Judge Baker, today.
 
We wrote an article several days ago in which we advised you that the Atlantic City Press was quite premature to declare the Dixon vs. Callaway Primary election "moot."
 
The decision is not available for publication without the approval of the Appellate Division of the Superior Court of New Jersey.
 
However, make no mistake about the accuracy of our report.
 
Joseph Gindhart argued the case for the appellant, former Atlantic City Councilwoman ... John Carbone argued for Craig Callaway.
 
We have also confirmed that the State Appellate Court determined that Judge Baker was wrong to have used the standard of "clear and convincing" as a burden for Dixon to overcome ... we stated this same point many times on "Hurley in the Morning" during the trial.
 
My final thought ... I want to make it clear that I am not inferring exactly what the State Appellate Court is thinking here ... however, it is my belief that they had to be moved to the extent that they believe that Dixon would have a good chance of prevailing ... for them to reverse and remand Judge Baker, yet again.
 
For the first time since all of this political madness began ... it is my stated opinion that Stephenine Dixon may just reclaim her Atlantic City Council seat.
 
At this point, it is more likely in my view that she will ... rather (then) that she won't.
 
This matter has been officially reversed and remanded for the completion of trial ... in other words, right back to Judge Baker, who has now been reversed twice on this matter.
