Atlantic County Judge Max Baker uses the higher "clear and convincing" standard to hand Callaway the Atlantic City 3rd Ward Council seat ... Regarding the Pleasantville Council race, Judge Baker does not give Maurice Callaway a victory

The Brothers Callaway received a "Split Decision" today.

Atlantic County Judge Max Baker has once again handed Craig Callaway the taste of sweet victory. In today's dramatic (trial) finale ... Stephenine Dixon Attorney, Joseph Gindhart need to prove that at least 232 votes cast for Callaway were fraudulent.

Gindhart presented 248 ballots which he believed were cast by fraudulent means. However, Judge Baker employed the higher standard of "clear and convincing" ... to which Gindhart was only able to prove 199 ballots to this higher standard.

Several law experts have conveyed to HarryHurley.com that Judge Baker could probably be reversed again ... as he was with his earlier decision ... however, an appeal this time does not look likely as we file this report.

In the Pleasantville Council case ... Judge Baker did not approve the motion to dismiss presented by Maurice Callaway. Powered by a high number of messenger absentee ballots, Maurice Callaway defeated incumbent Councilman Kenneth Prescott by 42 votes in the June Primary election.

However, Maurice Callaway does not look likely to be able to repeat his Brother Craig's success before this court. The reason ... Callaway's own hand writing expert has already agreed that 45 ballots cast for him are fraudulent. Gindhart believes that even more are fraudulent that the 45 previously mentioned. However, the case can't look good for Maurice Callaway, when his own experts have agreed on a number that would turn the election over to Prescott.

The Maurice Callaway/Prescott trial is scheduled to continue on Tuesday ... unless some other agreement occurs before then.

For the record, this is exactly what we predicted would occur. We believed firmly that fraudulent ballots would be proven in Atlantic City's 3rd Ward Primary election ... but that the ultimate number would fall short of enough to effect the final outcome.

What remains to be seen is what will happen next. Gindhart has already publicly stated that he will be sending a package of information to the New Jersey State Attorney General and the United States Attorney for New Jersey.

It will be interesting to see what they will do with a case of obvious fraud infecting the Atlantic City electoral process. View the 20 ballots of each of the Atlantic City (   CLICK HERE  ) and Pleasantville (   CLICK HERE   ) elections. Each represent just a small sample of like ballots which exist. Even the untrained eye has thus far agreed that the ballots and lots of them, have been signed by the same person.
