RPC 1.7 is entitled "Conflict of Interest."
It reads that "A lawyer shall not represent a client if the representation of that client may be materially limited by the lawyer's own interest." In other words a lawyer can not have a financial stake in the outcome of litigation other than his legal fee and be the attorney also.
The RPC states "a public entity cannot consent to any such undertaking."
Thus, by his own pleadings filed, Gallagher has raised the issue of whether he has breached RPC 1.7
This needs to be fully explored by Judge Val Armstrong and other oversight entities.
